Having the rental
agreement in writing is by far the best protection against being
involved in arbitrary landlord tenant legal disputes. By law,
the general duties of the tenant and landlord include:
Tenant
duties:

Must keep the apartment clean.

Must manage and
dispose of garbage and waste using the proper containers.

Must utilize all
electrical & plumbing fixtures properly.

Must ensure when
they use any appliances provided by the landlord, that it is
with due care and according to the intended use of the
appliance.

Follow local
housing, health and safety rules.

Must ensure as
tenants they, as well as their guests, not damage the
landlord's property or disturb neighbors.

Promptly notify
the landlord when something needs to be fixed.
Landlord
Duties:

Must adhere to all health and safety
laws and regulations.

Must promptly
make all repairs in order to maintain the property in good
condition.

Must ensure all
common areas are safe, clean, and in good repair.

Must ensure all
electrical, plumbing, heating and air systems, and provided
appliances are up to code and in good working order.

When there are
four or more rental units, must ensure appropriate garbage
cans and containers are provided.

Supply running
water and enough hot water and heat at all times, unless
there are separate heat or hot water units for each dwelling
unit and the utility fees for the heat and hot water are
paid directly by the tenant to a public utility company.

Provide a
minimum of 24 hours notice to a tenant before intending to
enter their dwelling, as well as the specific reason for the
need to enter the dwelling. The suggested entering of the
dwelling must also be at a reasonable hour. The
exception is if there is a viable emergency relating to the
material condition of the property. The landlord also had a
lawful duty not to abuse their right to enter the property.
